Collector's Rights Code, Intellectual Property, and Provenance of Artworks

1. Institutional Principles

D. Aster Gallery is dedicated to the preservation, representation, and commercialization of contemporary artworks, ensuring authenticity, provenance, exclusivity, and legal protection.

2. Intellectual Property

All artworks and contents are the exclusive property of the artist D. Aster or the gallery, protected by Law 9.610/1998, Law 9.279/1996, and applicable international treaties.

3. Nature of Acquisition

The purchase grants only the ownership of the acquired authenticated copy, without transfer of copyrights.

4. Collector's Rights

Private use, display on personal devices, printing for the buyer's property decoration, and backup copy.

5. D. Aster Gallery Provenance Registry

All artworks are registered in the gallery's proprietary provenance and authenticity system.

6. Certificate of Authenticity

Nominal document identifying the artwork, edition, holder, and Provenance Registry number.

7. Transfer of Ownership

Updating the Provenance Registry is free of charge. The issuance of a new Certificate of Authenticity in the name of the new holder may be requested upon payment of the current administrative fee and proof of transfer.

8. Use Restrictions

Reproduction, distribution, resale of copies, commercial use, NFTs, AI training, data mining, web scraping, and removal of authentication mechanisms without authorization are strictly prohibited.

9. Commercial Licensing

Any commercial use requires a specific contract.

10. Collector's Responsibility

The collector is responsible for the safekeeping of the digital file and the certificate.

11. Legal Protection

The violation of rights may lead to civil and criminal liability, where applicable.

12. Commitment to Authenticity

Each artwork is accompanied by documentation designed to preserve its provenance, exclusivity, and value over time.

Reservation of Rights

All rights not expressly granted remain reserved to the artist and D. Aster Gallery.
